Terms of Service
1. Parties & acceptance
These Terms of Service ("Terms") govern the provision of gym access, personal training and related services and the use of the website at thetrainstationgyms.com (the "Site") by PHOENIX COACHING SYSTEMS LIMITED, a company registered in England & Wales with its registered office at 20-22 Jaggard Way, Wandsworth, SW12 8SG, GB ("Phoenix", "the gym", "we", "our" or "us"), trading as "The Train Station Gym". By purchasing any pass, attending the gym or otherwise using our services, you ("Member", "Customer", "you") confirm that you have the authority to enter into a binding contract and that you accept these Terms in full.
2. Services
We operate The Train Station Gym at 20-22 Jaggard Way, Wandsworth, SW12 8SG. We provide access to gym equipment, group exercise classes, and one-to-one personal training. The scope of access for each pass is defined at checkout and on the Site (each a "Pass"). No service includes medical, physiotherapy or regulated health advice unless expressly delivered by a qualified third-party practitioner.
3. Ordering & payment
- All prices are displayed in United States dollars (USD) at checkout and are charged as a single one-time payment per Pass. There is no recurring billing, no joining fee and no auto-renewal.
- Payment is collected at checkout through our payment processor, Payzpool, which handles card acceptance through regulated upstream acquirers. We do not store card numbers.
- Charges appear on the cardholder's statement under the descriptor PHOENIX.
- A purchase becomes a binding agreement once payment has been successfully authorised and an order number has been emailed to you.
4. Use of the Pass
- Each Pass entitles a single named individual to the access and services described at checkout.
- Passes are non-transferable. Photo ID may be requested at the front desk on each visit.
- The Drop-In Pass entitles the holder to a single 90-minute training session on a single calendar day. The Day Pass + Coaching entitles the holder to all-day access and the additional benefits listed for that Pass.
- Passes that have not been redeemed within 90 days of purchase expire and become void.
5. Health, safety & liability waiver
Strenuous physical activity carries inherent risk. By purchasing a Pass and entering the premises you confirm that:
- You are at least 18 years old, or accompanied by a parent or legal guardian who has signed our paper Liability Waiver on your behalf.
- You have no medical condition that would make exercise inadvisable, or you have been cleared to exercise by a qualified medical practitioner.
- You will warm up, use the equipment correctly, and follow the reasonable instructions of our staff.
- You accept the residual risk of injury inherent in resistance training and conditioning, save for injury caused by our negligence (which we do not exclude).
Our full Liability Waiver forms part of these Terms. You will be asked to sign a paper copy on your first visit.
6. House rules
- Re-rack your weights, wipe down equipment after use, and respect other members and staff.
- Indoor footwear is required on the lifting platforms; outdoor shoes are not permitted on the turf strip.
- The use of unprescribed performance-enhancing substances on the premises is strictly prohibited and grounds for immediate removal without refund.
- Filming or photographing other members without their explicit permission is prohibited.
- We reserve the right to refuse entry, suspend or revoke a Pass without refund where house rules, the Liability Waiver or these Terms are breached.
7. Cancellation & refunds
Our refund rules are set out in detail in our Refund Policy, which forms part of these Terms. In summary: an unused Pass may be refunded in full up to twenty-four (24) hours before the booked session. After that point Passes are non-refundable except in the limited circumstances set out in the Refund Policy.
8. Personal property
Lockers are provided for the temporary storage of personal effects during a single session. We do not accept liability for items left in lockers overnight or for valuables that are lost or stolen on the premises. Members are advised to leave valuables at home or use the small-locker safe-deposit boxes at the front desk.
9. Limitation of liability
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability which cannot be excluded under applicable law.
- Subject to clause 9(1), our total aggregate liability to a Member arising out of or in connection with a Pass, whether in contract, tort (including negligence) or otherwise, shall not exceed the fees actually paid for that Pass.
- We shall not be liable for any indirect, consequential, special or punitive damages, nor for lost earnings, lost performance opportunities or loss of personal records.
10. Data protection
Personal data provided by the Member is processed in accordance with our Privacy Policy.
11. Force majeure
We are not liable for any failure to provide services that is caused by circumstances beyond our reasonable control, including but not limited to fire, flood, severe weather, public-health restrictions, utility failure, or industrial action. Where the gym is closed for an extended period, we will offer the holder of a paid Pass either a date-flexible re-booking or a refund.
12. Changes
We may amend these Terms from time to time. The version displayed on the Site at the time of purchase is the version that applies to that purchase.
13. Governing law & jurisdiction
These Terms and any dispute arising from them are governed by the laws of England & Wales. The parties submit to the exclusive jurisdiction of the courts of England & Wales.
